What is bail?

Bail Bonding is financial security in the form of cash, bond or assets that an arrestee gives to a court to promise that he or she will appear in court when ordered to do so. Who sets the bail or decides how much I have to pay&

How much can I end up paying for my bail?

Your bail cannot be excessive. The Eighth Amendment to the U.S. Constitution specifically states that. The system exists so an arrested person has the opportunity to be free until he or she is convicted of a crime. Judges are required to set bail at reasonable amounts - only the minimum amount necessary to keep the defendant from fleeing. However, judges do set very high bail, sometimes in the millions, to keep a suspect behind bars especially when there are alleged victims who fear for their safety. This is particularly true when it comes to murder, sexual assault cases or where the defendant is considered a “flight risk.”

What if I can’t come up with the bail?

You or your attorney can request the judge to lower the bail during your bail hearing. This request may be heard during a specifically set bail hearing or during your arraignment. Although California law states that an arrestee must be brought before a judge without delay, it could sometimes take several days to get a court hearing because of weekends, holidays or a full court calendar.

How do I pay for my bail?

First, you can pay a cash bail. If you don’t have the money, you can buy a bond from a bail bondsman by paying a 10 percent premium. A bond is a promise from you that you will appear in court when required. The premium is basically a non-refundable fee you pay to a bond seller. In addition, the bond seller may require collateral from you such as piece of valuable property to hold you accountable for your court appearance.

How long will it take for me to get out of jail?

That really depends on your specific case and situation. It also depends on whether you are being held in county or city jail. Your release from jail could take anywhere from an hour to an entire day.

Who is a bounty hunter?

A bounty hunter is someone who is hired by the bond salesman to hunt for suspects he bailed out and who failed to go to their scheduled court appearances. In California, Los Angeles and Riverside Counties, bounty hunters go through extensive training and background checks. The bondsman takes a considerable risk while posting bail because he is liable to pay the entire bail in court if the suspect fails to show up. The only situation when bounty hunters are used is when the bondsman stands to lose thousands of dollars. In a majority of cases, defendants make their court appearances and go through the legal process. In the end, the bail is returned to the person who paid it.
